 1. Overview of Services

Autism Genes (the clinic arm of TACGA) offers an online consultation service. The platform provides:
1.1 A medium through which a qualified Nutrigenomics Consultant (“Practitioner”) delivers consultations via VOIP or other telehealth methods. Appointments are delivered via a HIPAA-compliant secure Zoom platform.
1.2 A secure booking and payment service.
1.3 Access to information and resources related to consultations.

2. Agreement to Terms

2.1 By using the Autism Genes platform, you agree to these Terms of Use and our Privacy Statement. Do not use our services if you do not agree.
2.2 Autism Genes reserves the right to update these Terms without prior notice. The most current version will apply at the time of booking.
2.3 We are committed to high standards of care and continuous improvement. You may be asked to provide feedback.
2.4 Access may be suspended or denied at our discretion, particularly if behaviour is deemed abusive or threatening.
2.5 If your access is permanently revoked, your personal information may be deleted as per applicable law.

3. Privacy

3.1 We comply with Australian and American privacy laws and our Privacy Statement available at: https://autismgenes.com/privacy-policy/

4. Use Acknowledgements

You acknowledge that:
4.1 Autism Genes is not suitable for emergencies. In such cases, call your local emergency services or consult your local General Practitioner.
4.2 The relationship is between you and Autism Genes. All consultations are delivered by qualified Nutrigenomics Practitioners who are trained in the Autism Genes method and operate under our clinical framework. While the protocols and tools provided are developed by Autism Genes, each practitioner remains individually responsible for assessing suitability, applying clinical judgement, and adapting recommendations to each client’s needs.
4.3 Telehealth may not be suitable in all situations. You may be directed to alternate contact methods such as phone as needed.
4.4 Any prescriptions, referrals, or certificates are at the sole discretion of the Nutrigenomics Consultant, based on their qualifications and experience. All practitioners are required to hold their own professional indemnity insurance. Autism Genes provides clinical infrastructure, education, and coordination — but the duty of care rests with the consulting practitioner at all times.

5. Eligibility

5.1 Our services are delivered directly to the parent or legal guardian, who is considered the primary client. While the child is the focus of the treatment, attendance at appointments is not required, as all guidance and recommendations are communicated through the caregiver.
5.2 Services may only be used by and for the person named in the booking.
5.3 Autism Genes services are not required or recommended for young children (younger than Age 4).
5.4 Older teens with a strong understanding of their own needs and who wish to attend are welcome and encouraged to participate.

6. Your Information

6.1 You must provide accurate and current information and update it as needed.
6.2 Notify us immediately of any unauthorised access.

6.3 You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

6.4 If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to admin@autismgenes.com.

6.5 Carriers are not liable for delayed or undelivered messages.

6.6 As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

7. Accessing Services on Behalf of Others

Autism Genes does not allow third-party access without express written permission.

8. Bookings

8.1 No referral is required to access a telehealth consultation.
8.2 Booking confirmation will be sent via email, SMS, or phone.
8.3 For phone consults, you must be available at the confirmed time.
8.4 For video consultations, please follow the instructions provided.
8.5 If your appointment is delayed by us, we will attempt to reschedule at a mutually agreeable time.

9. Fees and Payment

9.1 Consultations are only confirmed once payment is received.
9.2 Fees are payable as per your written agreement with Autism Genes.
9.3 Payment methods include credit/debit cards and direct deposit.
9.4 Rebates may apply in some situations (e.g., NDIS). Inquire at booking.
9.5 We do offer payment plans. We require a deposit upfront and the balance to be paid over 12 months of the program.

10. Cancellations and Rescheduling

10.1 A minimum of 48 hours’ written notice is required to cancel or reschedule an appointment. If you’re unable to attend, we ask that you notify us in writing at least 48 hours in advance. While we do not charge a consultation fee, failure to provide notice will result in forfeiture of the appointment. We’re happy to reschedule with sufficient notice, up to two times throughout the program.
10.2 Rescheduling must be for a valid reason, otherwise the appointment may be cancelled at our discretion.
10.3 You may cancel via:

10.4 Refund eligibility is determined case-by-case.
10.5 Missed appointments (excluding technological faults on our part) are non-refundable.
10.6 A nominal admin fee may apply to cancellations or reschedules.

11. Nature of Telehealth Consultations

11.1 Consultations are delivered via phone or video call.
11.2 Your Nutrigenomics Consultant may determine telehealth is not appropriate and advise:
• A follow-up consultation
• Immediate emergency care
• Other appropriate actions
11.3 Electronic prescriptions may be offered where applicable, delivered by SMS, email, or printed copy.

12. Important Notes

12.1 Platform content is not medical advice and does not replace GP consultations.
12.2 Calls are recorded, but your consultation notes are securely stored in Australia.

13. Recording Policy

We record most consultations for ease of future reference for our clients. If you wish to opt out of recording your sessions, please let us know.

14. Intellectual Property

14.1 We retain ownership of all protocols, platforms, content and design.
14.2 Do not copy or reproduce any part of the service without permission.
14.3 You retain rights to any content you submit.
14.4 By submitting content, you grant us a royalty-free, perpetual license to use it publicly if relevant.

15. Third Parties

15.1 We may offer links to third-party services but hold no liability for their content or services.

16. Acceptable Use

16.1 You agree not to:
• Break laws
• Infringe on rights
• Upload harmful material
• Impersonate others
• Harass or abuse staff
• Damage our platform

17. International Use

International users engage at their own risk and must follow local laws.

19. Liability and Indemnity

19.1 You are responsible for your health records and decisions.
19.2 We are not liable for damages resulting from use or misuse of the service.
19.3 Where liability cannot be excluded, it is limited to resupply of service or cost refund.
19.4 You indemnify us against losses from your misuse of the service.

20. General

20.1 These Terms are governed by Australian law.
20.2 Invalid terms do not affect the validity of the rest.
20.3 We may transfer our rights without notice. You may not assign yours without permission.

21. Program and Pricing Modifications

21.1 We reserve the right to modify, update, or discontinue any aspect of the program—including its content, delivery, scheduling, or pricing—at our sole discretion and without prior notice.

22. Appointment Preparedness and Environment Requirements

To ensure the quality, safety, and integrity of our clinical consultations, clients are required to attend appointments in a focused, safe, and respectful environment. The following conditions apply:

22.1 Device and Location Requirements

  • Consultations must be attended on a computer or laptop or tablet, not on a mobile phone.
  • You must be in a quiet, private space, not outdoors, in public spaces, or in transit.
  • Driving during a consultation is strictly prohibited. Any consultation found to be taking place while a client is driving will be terminated immediately for safety and legal reasons. This is out of respect for the practitioner and to protect all parties involved.
  • Mobile phones do not offer adequate visibility of shared information, which may be highly detailed and visual in nature.

22.2 Environment and Attention

  • Please ensure young children are not present during the session unless they are the specific focus of the consultation.
  • Children should ideally be cared for in another room, at school, or asleep to allow full engagement and minimise interruptions.
  • Clients must be fully present and prepared, ideally with questions or notes ready.
  • Appointments where clients are distracted (e.g., pushing a child on a swing, shouting at others, or visibly inattentive) may be paused or rescheduled at the practitioner’s discretion. These behaviours undermine the quality of the consultation and the client’s ability to benefit from the session.

23. Client Dismissal and Refunds

Autism Genes reserves the right to dismiss a client from their program at any time, at our sole discretion, if we determine that the relationship is no longer clinically appropriate, productive, or aligned with our values and protocols.

  • In such cases, we will issue a pro-rata refund for the remaining portion of the program, calculated from the date of dismissal.
  • The cost of any test kits that have already been dispatched or used will be deducted from the refund total.
  • Test kits are non-refundable under any circumstances once they have been ordered or sent, as they are considered used medical or diagnostic items and cannot be returned or reused.

This policy ensures that our clinical team and clients remain in a respectful, collaborative relationship that upholds the integrity and purpose of the service.
